Client Coaching Agreement
This Agreement is entered into by and between Kara Pepper, MD, LLC (Coach) and Purchaser (Client) whereby Coach agrees to provide Coaching Services for Client.
Description of Coaching
Coaching is an alliance between the Coach and the Client in a thought-provoking and creative process that inspires the Client to maximize personal and professional potential. It is designed to facilitate the development of personal and professional goals and to develop and carry out a plan for achieving those goals.
Coach-Client Relationship
A. Coach agrees to deliver coaching services to the Client. These coaching services in no way represent a guarantee of outcome and will not serve to diagnose, treat, or heal any known or unknown medical condition. Client is solely responsible for creating and implementing their own physical, mental, and emotional well-being, decisions, choices, actions, and results arising out of or resulting from the coaching relationship. Client agrees that the Coach is not and will not be liable or responsible for any actions or inaction, or for any direct or indirect result of any services provided by the Coach.
B. Coach does not prescribe specific nutritional advice as per the state regulations of Georgia, but may coach the Client in goals related to healthier eating habits, mindful eating strategies, and developing a healthier relationship with food.
C. Coaching is not medical advice and does not substitute for advice from Client’s personal physician(s).
D. Client acknowledges that coaching does not involve the diagnosis or treatment of mental disorders as defined by the American Psychiatric Association. Coaching is not to be used as a substitute for counseling, psychotherapy, psychoanalysis, mental health care, substance abuse treatment, or other professional advice. It is the Client’s responsibility to seek such independent professional guidance as needed. If the Client is currently under the care of a mental health professional, it is recommended that the Client inform that provider of this coaching relationship. Coach does not offer psychotherapy and may refer the Client to other professionals as needed.
E. The Client understands that in order to enhance the coaching relationship, they agree to communicate honestly, be open to feedback and assistance, and create the time and energy to participate fully in the program.
Schedule and Fees
The Client may select from the following coaching packages:
- One (1) 50-minute coaching session
- Three (3) 50-minute coaching sessions
- Eight (8) 50-minute coaching sessions
The package selected at checkout determines the number of sessions available. There are no refunds.
Appointments
The time and location of coaching meetings will be determined mutually. The Client will initiate all scheduled calls to 404.491.9122 or connect through an agreed-upon video conferencing platform. The Coach will notify the Client if another number is to be used.
Confidentiality
This coaching relationship and all information shared are considered confidential. However, the Coach-Client relationship is not legally privileged. The Coach agrees not to disclose any Client information without written consent, except in the following cases:
- Information was already in the Coach’s possession.
- Information is publicly known or obtained from another source.
- Disclosure required by law or legal process.
- Risk of danger to the Client or others.
- Illegal activity is disclosed.
The Client agrees to raise any confidentiality concerns promptly.
Cancellation Policy
The Client agrees to notify the Coach at least 24 hours in advance for cancellations. The Coach reserves the right to bill for missed sessions. If the Coach must reschedule, the Client will be offered up to two alternate times or a refund.
Record Retention Policy
The Coach will retain secure, confidential records for seven years, after which they will be destroyed.
Termination
Either party may terminate this Agreement at any time with written notice. The Client agrees to compensate the Coach for all services rendered up to the termination date.
Limited Liability
Except as expressly stated, the Coach makes no guarantees or warranties. The Coach's liability under this Agreement is limited to the amount actually paid by the Client for services rendered through the termination date. The Coach is not liable for indirect, consequential, or special damages.
Dispute Resolution
If a dispute arises, both parties agree to attempt mediation in good faith. If unresolved, the prevailing party in legal action is entitled to attorney’s fees and court costs.
